ARTICLE I. IN GENERAL
Sec. 46-1. Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Bin means a metal receptacle with a capacity of three cubic yards, designed to be lifted and emptied
mechanically for use at commercial and industrial units.
Bulky waste means stoves, refrigerators, water tanks, washing machines, furniture and other waste
materials other than construction debris, dead animals, hazardous waste or stable matter with
weights or volumes greater than those allowed for carts.
Cart means a receptacle with a capacity of 90 gallons, constructed of plastic or fiberglass, designed
to be lifted and emptied mechanically, and having a tight-fitting lid capable of preventing entrance
into the container by vectors. The mouth of a container shall have a diameter greater than or equal
to that of the base.
Commercial and industrial refuse means all bulky waste, construction debris, garbage, rubbish
and stable matter generated by a producer at a commercial and industrial unit.
Commercial and industrial unit means all premises, locations or entities, public or private, requiring
refuse collection within the corporate limits of the city not a residential unit.
Construction debris means waste building materials resulting from construction, remodeling, repair
or demolition operations.
Contractor means the entity under contract or franchise with the city to provide the collection and
disposal service under this chapter.
Dead animal means an animal or portions thereof equal to or greater than ten pounds in weight that
have expired from any cause, except those animals slaughtered or killed for human use.
Disposal site means a refuse depository, physically located in the city or in close proximity thereto
including, but not limited to, sanitary landfills, transfer stations, incinerators, and waste
processing/separation centers licensed, permitted or approved to receive for processing or final
disposal of refuse and dead animals by all governmental bodies and agencies having jurisdiction and
requiring such licenses, permits or approvals.
Garbage means any and all dead animals of less than ten pounds in weight, except those
slaughtered for human consumption; every accumulation of waste, animal, vegetable and/or other
matter, that results from the preparation, processing, consumption, dealing in, handling, packing,
canning, storage, transportation, decay or decomposition of meats, fish, fowl, birds, fruits, grains or
other animal or vegetable matter including, but not by way of limitation, used tin cans and other food
containers; and all putrescibleor easily decomposable waste animal or vegetable matter which is
likely to attract flies or rodents; except, in all cases, any matter included in the definitions of bulky
waste, construction debris, dead animals, hazardous waste, rubbish or stable matter.
Hazardous waste means any chemical, compound, mixture, substance or article which is
designated by the United States Environmental Protection Agency or appropriate agency of the state
to be hazardous as that term is defined by or pursuant to federal or state law.
Out of city means residential, commercial and industrial customers outside the city limits.
Producer means an occupant of a commercial and industrial unit or a residential unit who generates
refuse.
Refuse means residential refuse and bulky waste, construction debris and stable matter generated
at a residential unit, unless the context otherwise requires, and commercial and industrial refuse.
Residential refuse means all garbage and rubbish generated by a producer at a residential unit.
Residential unit means a dwelling within the corporate limits of the city occupied by a person or
group of persons comprising not more than four families. A residential unit shall be deemed occupied
when either water or domestic light and power services are being supplied thereto. A condominium
dwelling, whether of single or multilevel construction, consisting of four or less contiguous or separate
single-family dwelling units, shall be treated as a residential unit, except that each single-family
dwelling within any suchresidential unit shall be billed separately as a residential unit.
Rubbish means all waste wood, wood products, tree trimmings, grass cuttings, dead plants, weeds,
leaves, dead trees or branches thereof, chips, shavings, sawdust, printed matter, paper, pasteboard,
rags, straw, used and discarded mattresses, used and discarded clothing, used and discarded shoes
and boots, combustible waste pulp and other products such as are used for packaging, or wrapping
crockery and glass, ashes, cinders, floor sweepings, glass, mineral or metallic substances, and any
and all other waste materials not included in the definitions of bulky waste, construction debris, dead
animals, garbage, hazardous waste or stable matter.
Stable matter means all manure and other waste matter normally accumulated in or about a stable,
or any animal, livestock or poultry enclosure, and resulting from the keeping of animals, poultry or
livestock.

Sec. 46-2. Container regulations. (a) The lids or covers of all garbage containers shall at all times be kept secure and fastened so that flies and other insects may not have access to the contents thereof. Such lids or covers shall only be removed while the containers or receptacles are being filled or emptied, as the case may be. (b) Every person owning, managing, operating, leasing, maintaining or renting any premises, or any place where garbage accumulates shall maintain their entire premises, and any portion of the alleys and streets of the city that are used by them to store garbage cans, as allowed under this section, in such a manner as to prevent the breeding of flies and mosquitoes. (c) No person shall permit any garbage of any character whatsoever to be exposed to the open air except when the same is being emptied into a container. (d) Garbage containers and the area around where they are located shall be kept in a sanitary condition. A suitable repellent, of a type prescribed by the city health officer, or other authorized representative, shall be used at places where garbage cans are located in order to keep down odors and to prevent the breeding of flies and mosquitoes. (e) The meddling with garbage containers, or in any manner pilfering and/or scattering the contents of any garbage container within the city is prohibited. (Code 1979, ch. 11, § 4 F.)

Sec. 46-3. Burning, burying or similar disposal.The disposal of garbage by fire, burial or any method
other than provided in this chapter in any place within the city is absolutely prohibited.(Code 1979,
ch. 11, § 4 N.)Sec. 46-4. Inspection and enforcement of chapter.In addition to the usual
enforcement agencies of the city, it is hereby the duty of the city manager or his authorized
representatives to make inspection trips at regular intervals to determine whether or not garbage and
trash is being properly collected, removed, and disposed of as required by the provisions of this
chapter or any other applicable agreement or ordinance. If it is found that this chapter or any other
applicable agreement or ordinance is being violated, appropriate and timely action shall betaken to
insure full compliance with its provisions.(Code 1979, ch. 11, § 4 S.)
